General conditions of our affiliation scheme

Article 1. Acceptance of the affiliate by di-arezzo.com

All those wishing to participate in the di-Arezzo.com affiliation scheme must fill in the application form on the di-arezzo.com Web site.
Affiliation is a personal matter and di-arezzo.com reserves the right to refuse any application, without giving reasons, that it deems incompatible with the purpose of the affiliation.
Enrolment in the affiliation scheme is free of charge. No joining fees, no entry fees.

Article 2. Obligations of di-arezzo.com

Sales are directly concluded between visitors to the affiliate’s site and di-arezzo.com, the latter remaining responsible for proper fulfilment of the order. The clientele belongs to di-arezzo.com. All orders are received and processed by di-arezzo.com, who invoices and collects payment and delivers the goods without the affiliate being involved.

Article 3. Commission

Every three months, di-arezzo.com sends the affiliate a statement of the sales figures corresponding to orders placed though his site (except for those quarters in which no sale has been registered). These sales comprise all orders that have been fully processed (paid for and delivered) before the statement date. We stress that these figures include only those orders placed directly through the affiliate’s Web site. Any further orders placed elsewhere by a previous visitor to his site are excluded.
Affiliate orders are easily identified by the presence of a marker bearing the affiliate’s name when these are forwarded to di-arezzo.com. In no case can di-arezzo.com be held responsible for a technical error that an affiliate or his representative might have made in the technical implementation of his links.
The statement will be accompanied by a draft commission invoice as soon as the running total for the commission exceeds 80 Euros ex-VAT. Commission will be paid within 30 days of invoicing.
This commission amounts to 8% of the total order value exclusive of returns, unpaid amounts, taxes, and shipment costs.

Commission can only be paid to affiliates whose invoices state the official registration number of their company or business, or in the case of non-profit organisations, the reference of their registration with the body at which they are incorporated.

Special measures for private individuals :
In France, any affiliation scheme is considered a service offering that forms part of a partnership agreement. Affiliation is therefore equivalent to a business activity. To participate in the di-arezzo affiliation scheme, individuals must set themselves up as a "micro enterprise", which provides a simplified taxation system.

In France, micro-enterprise status is available only to those individuals whose business revenues do not exceed 26,678 euros per year ex-VAT (this includes all revenues, whatever their source, not just commissions).

The status described above is currently the only one that can enable a private individual to participate in an affiliation scheme. Unlike companies, affiliates who abide by the rules above can opt out of the VAT system. Furthermore, they do not have to produce profit and loss accounts and balance sheets. They must however keep a written chronological record of the amounts and origins of commissions received and back this up by invoices.

In France, affiliates with " micro enterprise " status must enter the amount of commission earned over the year under the correct heading in their annual income tax return (BIC - Bénéfices Industriels et Commerciaux, form 2042). An automatic expense allowance of 50% is deducted by the tax authorities.

The affiliate must issue invoices. These may be issued in electronic form. There must be two copies of each invoice, one going to diarize and the other kept by the affiliate. The invoice may be sent by e-mail but a printed copy must nevertheless be kept by both parties. Invoices must be kept for 4 years in case they are needed in any situation of dispute.

To conclude :

To help you monitor the sales generated on your site, diarize sends you a quarterly activity report by e-mail including an invoice for you to complete, send us a copy, and print a copy out for your own records. In no circumstances can diarize be held responsible for errors or omissions in the information given here: the French authorities are liable to modify their measures at any time.

Article 4. Various provisions

This affiliation scheme is entered into non-exclusively with the affiliate for an indefinite period, knowing that either of the parties can terminate the agreement at any time without notice by advising the other party of this termination by registered letter with acknowledgement of receipt.
It is explicitly understood that granting access to the programs and data contained in the di-arezzo.com on-line store does not imply that the affiliate has any claim to rights on these programs and data, which remain the sole property of their authors.
The present conditions can be unilaterally modified by di-arezzo.com. If such modifications affect the amount of commission paid, this will be made known to the affiliate. The changes will take effect one month after such notice unless the affiliate advises di-arezzo.com of his desire to leave the affiliation scheme before this period has expired.
Both parties undertake to attempt to resolve any conflicts amicably where these concern the interpretation, execution, or interruption of the affiliation scheme. If such conciliatory measures do not lead to a solution, the matter will be referred to the Paris courts.
